Statement by the Diplomatic Bureau of JKLF in London

Statement by the Diplomatic Bureau of JKLF in London

Statement by the Diplomatic Bureau of Jammu Kashmir Liberation Front:
Issued in London at JKLF’s International Secretariat.

London- 2 June 2016:

The focus of this statement is on the following two main points:
(a) the conspiracy to engineer demographic change in the valley of Kashmir under the guise of Pandit resettlement and:

(b) the threat to Jammu Muslims from communalist forces of the BJP/RSS nexus.

Indian government’s policy to construct huge separate townships on the West Bank model, (Israeli style Settlements), is a deliberate attempt to create social, political and demographic dislocation of Kashmir.
Under the guise of  Pandit resettlement, Indian government has embarked on construction of separate enclaves, including sainak or the ex-service men colonies in the Valley, despite the fact that, upon retirement service personnel return to their family homes.
It has decided to give land to non-Kashmiri industrialists, and accommodate homeless people in the valley from outside Jammu Kashmir, especially since there is a shortage of land in the Valley of Kashmir.
Kashmiris have strongly reacted to this nefarious attempt by the Indian state, and its local BJP/PDP quislings, to divide the population on ethnic and religious lines, and to create a perpetual state of uncertainly within Jammu Kashmir, and especially in the Valley.
JKLF Chairman Mr Yasin Malik, and other pro freedom and pro people leaders, have taken the matter of Indian policy, to build separate colonies, very seriously.
Over the recent months, JKLF Chairman has mobilised, political and civic opinion across all sections of Jammu Kashmiri society to mount an effective resistance to Indian policy through a united Front. Notably he met with Syed Ali Gilani and Mirwaiz Umar Farooq among many others.
Since 25 May however, Mr Yasin Malik has been incarcerated, initially under Police custody, and since 29 May in Srinagar central jail.
This is a deliberate attempt by the Indian state and its local quislings, to prevent JKLF’s Chairman from further contacts with the public and opinion makers in Jammu Kashmir.
Mr Yasin Malik’s arrest and incarceration therefore exposes the charade of ‘Indian democracy’ in Jammu Kashmir.
Leaders of the All Parties Huriyat Conference-APHC- Mirwaiz Molvi Umar Farooq APHC (M) and Syed Ali Shah Gilani APHC (G), and vice Chairman of the JKLF Mr Shaukat Bakhshi have been put under house arrest since 25 May; while JKLF zonal president Noor Muhammad Kalwal and organiser Bashir Kashmiri have evaded arrest as both have gone underground.

Mr Yasin Malik and the APHC leaders, Syed Ali Shah Gilani (G) and Mirwaiz Umar Farooq (M), have jointly called Friday 3 May as a day of protest, and called on the population to hoist and wave black flags throughout the Valley, against the oppression of the Indian state and its quislings in Jammu Kashmir.
Mr Yasin Malik in a message from Srinagar central jail has said that it was a life and death situation for Kashmiris and that it was important to mount a united front against the Indian machinations against the people of Kashmir.
It must be remembered that over ten thousand Pandits live and engage in business throughout the valley of Kashmir without fear, including having businesses in the Lal Chawk area of Srinagar itself in complete safety.
There is therefore, no justification for India to construct separate Colonies for Pandits or any other section of society in the Valley or any other part of Jammu Kashmir.
We do however demand, that Indian government gives necessary financial support (one crore rupees for each family) for Pandit families, to buy property wherever they wish in the Valley.
Also in view of deepening communalisation of Jammu Kashmir society by the BJP, we are extremely concerned for the safety of Muslim population in Jammu.
In this regard we consider the words of BJP minister Lal Singh deeply offensive, and full of intimidation to Muslims of Jammu, when he reminded them of the 1947 massacres, in which at least three hundred thousand (3 Lakh) Muslim residents were massacred, in what can only be described as deliberate and calculated actions of extremists, to eliminate Muslim presence in Jammu region of the state.
Lal Singh conveyed his threat when a delegation of Jammu Muslims met him on 20 May with their grievances. Instead of redressing their complaints, he reminded them of what happened to their kith and kin in 1947.
It is sad to note that people like Lal Singh, inspired by communalist ideology of the RSS in 1947, were responsible for the massacres, and of forcing more than half a million Muslims to flee for safety, in Azad Kashmir and the Punjab in Pakistan.
In view of Lal Singh’s threat to Muslims of Jammu with dire consequences, and considering the violent nexus and ideology of the RSS and the BJP, we call upon the international community to take these threats against Muslims in Jammu seriously.
It is our firm view therefore that construction of vast colonies in the valley, is an attempt by the Indian government, under the guise of Pandit resettlement, to change demographic character, and create social dislocation of not only the Valley, but whole of Jammu Kashmir.
Furthermore it is an attempt to create facts on the ground by changing the majority into minority in Indian Held Jammu Kashmir.
It is an attempt by the Indian state to bring about fragmentation of the Valley of Kashmir by erecting an iron curtain through construction of these huge townships.
We firmly reiterate our strong resolve to resist this diabolical Indian policy of building huge militarised fortresses that would be similar to the West Bank Settlements by Israel in Palestine, under the guise of Pandit resettlement.
We will take appropriate and effective diplomatic and political actions to counter Indian policy by supporting the anti-status quo and pro- people leadership in Indian occupied Jammu Kashmir.
We demand that Indian authorities and their local quislings immediately release Mr Yasin Malik from arbitrary incarceration as well as Huriyat and JKLF leaders from house arrests.
We call upon the international community to take note of these undemocratic and oppressive methods of the Indian state and its agents in Jammu Kashmir against peaceful and legitimate political rights and activities of the pro- people and anti-status quo Kashmiri leadership.
As part of our concerted diplomatic and political actions, steps will be taken to organise public demonstrations against Indian Embassies and Diplomatic Missions in Europe, UK, the United States, and in Pakistan and Azad Kashmir.
In his message from Srinagar Central Jail, Mr Yasin Malik expressed his delight over the successful operation of Pakistani Prime Minister Muhammad Nawaz Sharif, and extended solidarity with Prime Minister Sharif’s family and prayed for his early recovery.
Mr Malik also expressed his heartfelt grief and sorrow over the sad demise of Malik Muhammad Shafi, a founding member of the JKLF and right hand man of JKLF supreme head jenab Amanullah Khan marhoom, and expressed his condolences with the family and prayed for Malik Shafi  sahib’s heavenly abode……

Srinagar// incarcerated JKLF chairman Muhammad Yasin Malik has been today sent to Srinagar central jail. He was kept at Kothi Bagh police station for last 5 days and was not presented before any court or magistrate after which he wrote a hand written letter to chief justice of high court Srinagar.

In his letter Yasin sahib wrote that that it has become the routine of the government authorities to regularly put him behind bars without following the due procedure of law. That he has been arrested more than hundred times in last few years without lodging any FIR and during this time he has not even been produced before any executive or judicial magistrate.

Yasin sahib wrote that his liberties have been off and on curtailed and unnecessarily interfered with and it  has been now four days since he was lodged in an isolated room of police station Kothibagh and he has till now not been produced before any magistrate.

It is in place to mention that he was treated for various health issues and was discharged from a hospital recently. This letter was delivered at the residence of chief justice day before and today morning JKLF chairman was shifted from kothibagh police station to police control room hospital after which he was shifted to central jail Srinagar.

Before being sent to central jail, JKLF chief in a message said that jail is his second home and if so-called rulers realize that they can deter resistance camp from perusing the path of justice by means of oppression, suppression, jails and interrogations then they are living in fool’s paradise.

Incarcerated JKLF chairman Muhammad Yasin Malik said that no Kashmiri will ever accept Jammu Kashmir being turned into another Palestine and conspiratorial designs of India that are being implemented by its Kashmiri stooges will face a stiff resistance from Kashmiris.

He said that construction of separate settlement colonies in the name of Pandits, colonies for ex-Indian army men, East India company type industrial policy, and oppression against Jammu Muslims are designs to change demography of Jammu Kashmir and rulers and their masters should know that they will face stiff resistance from us on these issues.

“Taking a dig at Ms Mehbooba for her “Pigeon and Cat” statement he said, “This speaks of Ms Mehbooba Mufti’s mental bankruptcy.” Yasin malik said that the power has totally exposed her and her true colors are fast coming to surface slowly. Yasin said condemning the statement, “Muslim Kashmiris have never touched rather ensured safety and security of Kashmiri Pandits who are part and parcel of our communal brotherhood.”

He reminded Ms Mehbooba of 1947 massacre of Jammu Muslims, Kashmir massacres, saying, “Cats are those who killed and massacred Muslims of Jammu in 1947; are those who are responsible for countless massacres including Gawkadal, Kupwara, Handwara, Sopore, Vandhama, Hawal, Khanyar, Chattisinghpora, Bijbehara and countless other killings.''

“Role of Indian armed forces and Jammu and Kashmir Police is akin to that of cats Ms Mehbooba Mufti has talked about,” Malik asserted, “it is they who have selectively killed and tortured Muslims of Jammu and Kashmir.”The jailed leader said, “Ms Mufti is lost in the garb of power.

Yasin Malik said that situation is like do or die for Kashmiri nation and if it needs our blood to stop these conspiratorial designs we will spill that too but will not let these conspiracies to succeed. Yasin sahib said that so-called rulers by oppressive methods like Arrests, raids, intimidations, jails, tortures, false propaganda want to defer us from our resistance but they should know that these measures will not and can never deter us from perusing the path of Azadi and protecting our national interests.

A brief profile of Supreme Head JKLF, Jinab Amanullah Khan sahib.

A brief profile of Supreme Head JKLF, Jinab Amanullah Khan sahib.

Supreme Head JKLF, Jinab Amanullah Khan was born in 1931 in Astore, Gilgit. He did his primary schooling in district Kupwara and later did Matric in its Tehsil Handwara incf IHK where he was living with his sister.

He stood first in Matric exams amongst the Muslim students in IHK and got scholarship for further studies is S P College and Amar Sing College where from he was once arrested and later was again issued an arrest warrant on the pretext of holding demonstrations against India and the maharaja in 1952.

In order to evade arrest, he went for hiding and crossed over to Pakistan / AJK via Sialkot through Jammu along with a family who happen to be the relatives of KH Khursheed, former President of AJK. Punjab govt did not recognise the certificates of IHK, therefore In the continuation of higher studies he got admission in Peshawar University and later in Karachi in 1953 where from he did his masters in journalism followed by LLB.

He was elected as the general secretary of Students Federation in Karachi and continued his political activities for the freedom and independence of Jammu Kashmir.

He formed Kashmir Independence Kashmir in 1957 and could gather only 25 people across JK at that time to confront and challenge 'give and take' policy of Pakistan led by Gen. Ayub Khan with India on Kashmir. He along with other colleagues formed JK Plebicite Front and was elected its first Secretary General in its first ever convention whose office bearers took oath at Sucheetgar near LOC in early 60's.

In Karach he continued his studies and worked too to fulfil his needs. He later managed to establish his own school in Karachi which proved his only earning source till his last breath. He went to UK in early 70's where from he started his activities for Kashmir. Besides many protests and activities, he led a team of 4 youngsters who held a protest inside the UN General Assembly Hall in late 1970's when Indian PM stood up to address the august gathering.

He formed JKLF in 1977 in UK and returned back in 1983. After the Mahatre, an Indian diplomat who was kidnapped and later killed by some young kasmiri's who demanded Maqbool Butt's release, in UK he was arrested there on the behest of India through Interpol in 1985.

He was operated upon while being in custody in UK for 15 months when he was diagnosed with lungs cancer and his 3/4th part of it was removed in 1986. He is the pioneer of current freedom struggle in IHK that started in 1987 with the inception of militancy under the banner of JKLF led by him.

He is man who challenged the Indian rule in IHK and continued the political struggle of Independent Kashmir in AJK as well. He formed a govt in exile in 1990 with its head. On his call many big pro freedom rallies in both the sides of JK State were held that included crossing of CFL in 11 Feb. 1992 via Chakoti, Muzaffarabad AJK. He managed to form an organisation that has its basis in every province of JK across the CFL.

He believed in oneness of the State of JK and rejected any out of box solution based on the division of the State. He reunited JKLF in 2012 that had underwent division in 1994 and expressed his fullest of faith in Yasin Malik as its leader and Chairman. He wrote dozens of pamphlets, booklets and books on Kashmir and to promote the ideology of Independent Kashmir that included Juhd-e-Musalsal with three editions.

He presented his Kashmir case at different local, regional and international fora's and got overwhelming response from world around. He was a pious, dedicated, nationalist and selfless leader and founder of this freedom struggle.

He campaigned in Gilgit this year from 20th January to 3rd March against announcing Gilgit Baltistan (GB) a province of Pakistan. During this campaign he met and convinced a cross section of political parties that included the CM and Governor of GB.

During this tour he got lungs and chest infection for which he was admitted in Shifa International Hospital, Islamabad where the doctors diagnosed Pneumonia and cronic pulmonary disease. He was discharged from hospital on 14th of April after he got stable.

Just 5 days ago he was again hospitalised in Hearts International Hospital in Saddar Rawalpindi after he complained some breathlessness. He was very conscious, alert and could recognise everyone who would pay a visit to him until his last moment but was not able to talk much because doctors had once again diagnosed pneumonia.

He after taking breakfast today early morning breathed his last at about 08:30. His nimaz-e-jinaza will be offered tomorrow at 11:00 am in Liaqat Bagh, Rawalpindi and soon after jinaza he will be taken to Gilgit for burial to fulfil his last wish.

He has made this wish with the intention that his tomb may prove a bond between GB with the rest of the divided parts of the State of JK especially with AJK and IHK.

He was married in 1974  in Parishing, Astore, Gilgit. Along with the thousands of his well wishers, he left behind his only daughter Asma Khan and his widow.

The Right to self Determination of 20 million people of Jammu Kashmir

The Right to self Determination of 20 million people of Jammu Kashmir.

Presented at the International Conference on Conflict Resolution through Self-determination:

Hosted by Parliamentarians for National Self Determination -PNSD – at the: House of Lords London:  Tuesday 26 April, 2016

Zafar Khan

Chairman I would like to extend my gratitude to the organisers of this important and timely conference, in the British Parliament on a fundamental principle of  human rights- the right of self-determination.

Denial of the right to self-determination leads to violation of all other collective and individual human rights. In the brief time that I have, I will address the concept of the right of self-determination in relation to the Kashmir issue, and the denial of this important right to 20 million people of Jammu Kashmir.

At the outset however, we must acknowledge that the biggest danger to peace in South Asia, is the unresolved issue over Jammu Kashmir’s future political status. Currently Jammu Kashmir-generally referred to as Kashmir- has a huge number of military presence on both sides of the Line of Control-LoC- that forcibly divides the territory and its 20 million inhabitants between India and Pakistan.

Kashmir however, is not a territorial dispute between the neighbours, nor is it a domestic law and order matter for India. It is an international issue that concerns the democratic right of 20 million people who must accorded the opportunity, to decide upon their political destiny, in accordance with their inherent, and inalienable right to self-determination.

Self-Determination as a Concept:
Chairman allow me to briefly, say a few words about the concept of self –determination: Historically the idea of self-determination can be traced to the American declaration of independence in 1776.

This simply meant that those who were governed must give their consent to be governed, and that people have the right to shape their own destiny. Subsequently the French Revolution reinforced this idea with the concept of popular sovereignty.

At the end of World War 1 US President Woodrow Wilson advocated the idea of self-determination in his 14 points, and thus the concept founds its way into the UN predecessor the League of Nations. The United Nations’ Charter in its article 1(2) reinforces the principle of justice, equal rights and self-determination.

However, significant and more emphatic developments in the articulation of the concept emerged with the UN’s Declaration on granting of independence to colonised people in the General Assembly-GA- resolution 1514 of December 1960.

The International Covenant on Civil and Political Rights-ICCPR- of Dec. 16- 1966 which was adopted in March 23- 1976, consolidated the process on the idea of self-determination as a fundamental, and an inalienable right, inherent with all, and especially  subjugated people throughout the world.

The International Covenant on Civil and political rights emphasises civil, political, economic and cultural rights of nations and peoples. Article 1 for example states that;

“All people have right of self-determination. By virtue of that right they freely determine their political status, and freely pursue their economic, social and cultural development”. *

India has not ratified article 1 of the ICCPR,  and  made  the  following  declaration to the effect  for exemption:

“ With reference to article 1 of the International Covenant on Economic, Social and Cultural Rights and article 1 of the International Covenant on Civil and Political Rights, the Government of the Republic of India declares that the words `the right of self-determination' appearing in [this article] apply only to the peoples under foreign domination and that these words do not apply to sovereign independent States or to a section of a people or nation--which is the essence of national integrity.**

Chairman, with more than half a million regular soldiers, supported by tens of thousands of paramilitary forces deployed in Jammu Kashmir, one wonders what is India’s idea of ‘people under foreign domination’!

Kashmiris certainly feel dominated, and indeed subjugated by the Indian state, and have done so since 1947.

Indian forces of occupation over the past 28 years alone, have been responsible for around a hundred thousand deaths of Kashmiri people, over 8000 missing and with 7000 un-marked graves. The suffering and brutalities inflicted on, and endured by Kashmiris, at the hands of militarised Indian state apparatus is nothing other than the actions of a colonial power subjugating a colonised people by sheer force.

Kashmiris have not given their consent to the Indian state to rule over them. If ever there was consent it was conditional, and the India State   has not fulfilled its side of obligations in the temporary arrangements of 1947.

Furthermore the Indian army and para military forces, operate in Jammu Kashmir with impunity of action under cover of laws such as the Armed Forces Special Powers Act –AFSPA-.

If such militarised oppression against Kashmiris by the Indian State is not colonial in form and substance, then we can ask the question, what constitutes a colony and a colonial power?

Chairman India claims to be the largest democracy in the world, and demands a top seat at the United Nations as a permanent member of the UN Security Council-UNSC- . This is quite something coming from a UN member State which deliberately chooses to ignore around one dozen resolutions of the United Nations, specifically passed by the world body to determine the future status of Jammu Kashmir in accordance with the wishes of its people.

The UN resolutions call for a plebiscite to determine the future status of Jammu Kashmir. If this   is not self-determination one wonders what other definitions can be applied to the struggle of valiant Kashmiris who have risen up against the straight- jacket of the status quo in their forcibly divided country, at every opportunity since 1947.

As we know the genesis of Kashmir issue, at international level at least, begins with India taking the issue to the UNSC on 1 January 1948. As pointed out above, the UN passed more than a dozen resolutions since 1948 on the issue. It’s UN Military Observer Group on India and Pakistan-UNMOGIP- is operational in the territory, under resolution 47 of April 1948. (See Bowers 2004)

Solemn commitments were made and pledges were given by India, that were supported by major powers like the USA and the UK, to have the issue resolved in accordance with the, unfettered right of Kashmiris over the political status of their country.

Chairman, who can begrudge Kashmiris for feeling betrayed, at the indifference and abandonment of their inherent and inalienable fundamental human right- the right to national self-determination, a right that India and the major powers recognised and accepted.

India for example in one of its many solemn pledges on Kashmir declared:

“that the question of Kashmir’s future status vis-a-vis its neighbours and the world at large and the question on whether Kashmir should withdraw from her accession to India, and either accede to Pakistan or remain independent with a right to claim admission as a member of the United Nations all this we have recognised to be a matter for unfettered decision by the people of Kashmir after normal life is restored to them” UNSC document Agenda 227. ***

Unfortunately Chairman India has reneged on the above and all the other commitments, and quite blatantly chooses to ignore the existence of Kashmir issue, and considers it as a figment of Kashmiris’ imagination, or machinations by Pakistan against it.

India consistently prevaricates over its bilateral Shimla Accord of 1972 with Pakistan, which Kashmiris as a matter of fact do not recognise, and call upon the government of Pakistan to rescind the Shimla Accord forth with, as this bilateral agreement negates the Kashmiri dimension in the issue, and turns this legitimate international issue of self-determination of a subjugated nation, into a dispute between India and Pakistan.

Chairman we peacefully resist the oppression and indignities of Indian occupation, and assert our right to freedom and free Will, through political and democratic activism.

But as the world witnessed the killing of five innocent Kashmiris in Handwara and Kupwara over the last week, the Indian occupation forces are impervious to the world opinion, because they have the cover of laws to act with impunity.

Indian military resorted to brute force when spontaneous outpouring of anger by residents erupted after an Indian soldier attempted to molest a 16 year old girl. The army in collusion with the local Police made every effort to harass the girl, and her family to force her to sign a statement, absolving the soldier of his heinous attempt to dishonour her.

While such heinous acts by the Indian military personnel are common, Kashmiris in Handwara and Kupwara have proved through their peaceful spontaneous reaction that they will no longer tolerate occupation and its excesses and indignities against the populace, and especially against the women of Jammu Kashmir.

Chairman in conclusion this is the backdrop within which the valiant people of Jammu Kashmir wage their peaceful struggle for the right to self-determination. A struggle whose leaders are frequently arrested to deprive them of their democratic right to engage with the public, and the right to free speech and free movement.

Both in Handwara, Kupwara and elsewhere in Kashmir, pro freedom leadership was arrested, including the arbitrary arrest and incarceration of JKLF Chairman Mr Muhammad Yasin Malik.

Essentially therefore the question over the future status of Kashmir is one that concerns the fundamental right of Kashmiris, to determine their political destiny, by exercising the sovereignty vested in them, on the political status of Jammu Kashmir, and its future disposition.

And this is the basis upon which Kashmir issue can be resolved. It is poignantly relevant to repeat here, what Mr Yasin Malik in a statement, only a few days ago, told the Indian Prime Minister Mr Narendra Modi that ‘all roads to peace and prosperity for India and South Asia went through Jammu Kashmir’.

Chairman until this vitally important fact is recognised in New Delhi, the suffering of 20 million Kashmiris will continue, and the threat to peace and prosperity in the region, will remain much too real. Thank you Chairman.

JKLF Diplomatic Bureau meeting with British Foreign Office

Rt. Honourable Mr Philip Hammond
Secretary of State for Foreign and Commonwealth Affairs
C/OP the Foreign & Commonwealth Office South Asian Department.
King Charles Street London SW1A 2AH

7 April 2016

Dear Secretary of State,

Sub- The right of 20 million Kashmiris to freedom, democracy and reunification of their forcibly divided country.

During your recent visit to Pakistan, and contrary to decades old British policy on the unresolved Jammu Kashmir issue, you advised Pakistan Government, not to include the question of Kashmir’s future status as part of its dialogue with India.

Secretary of State, we find your advice unprecedented and inconsistent, especially since the United Kingdom is far more cognisant and privy to the historic context of the conflict over Kashmir, and has traditionally recognised its resolution as being central for lasting peace in South Asia.

The advice therefore has been received as a great disappointment within the million strong British Kashmiri diaspora, as well as a cause of serious concern across both sides of the Line of Control-LoC- that divides Kashmir, and forcibly separates its 20 million people between India and Pakistan.
Kashmiri leadership in particular, has interpreted this advice as a reversal of British policy due to the UK’s changed priorities in South Asia. Kashmiris have always expected Britain to support their legitimate, just and internationally recognised rights and aspirations as part of a process towards a peaceful resolution of the issue.

Especially as in our considered view, Britain has a key role in persuading India and Pakistan, to seek a solution of the issue, by recognising and accommodating, the locus standai in the conflict, of 20 million Kashmiris as the arbiters over Jammu Kashmir’s reunification and political status.

It is not only unfortunate but lamentable that India of today, contrary to its commitments before the international community and to the people of Jammu Kashmir, does not even recognise the existence of Kashmir issue or Kashmiri dimension- a dimension- that encompasses aspirations and fundamental rights that have yet to be exercised over the political status of forcibly divided Jammu Kashmir.

What must also be questioned and seriously addressed is the huge military deployment of forces by both India and Pakistan in the territory from north to south, where both armies aggressively confront each other eye-ball to eye-ball across the LoC.

Secretary of State this 700 mile long LoC which, as far as the basic right of movement is concerned does not and should not apply to inhabitants on either side of the forced divide within International law and UN resolutions, is nevertheless a living hell for tens of thousands of Kashmiris who reside alongside it.

During frequent flare ups between both armies along the length of the LoC hundreds of villages are caught in the cross fire as both armies are deployed either in or close to the populated areas.

Equally Indian military and paramilitary forces are heavily deployed in the rural and urban areas of Indian occupied parts of Jammu Kashmir. This Indian military presence is extremely intimidating and disruptive of the daily lives of ordinary people- many are killed daily with no provocation against the military.

Indian army operates under cover of laws such as the Armed Forces Special Powers Act-AFSPA- that give the Indian forces in Jammu Kashmir, the impunity and immunity to perpetrate acts of violence on a daily basis against civilians that result in deaths of innocent men, women, young and old alike. Many of the basic rights of Kashmiri people are violated daily by this blanket cover of immunity that the Indian military apparatus has enjoyed in Indian held Jammu Kashmir over the past 28 years. Over a hundred thousand have been killed by the Indian military and paramilitary forces, around 8,000 are missing while over 7,000 unmarked graves are found throughout Indian held Jammu Kashmir. Women’s dignity is violated including rapes.

Pro freedom and reunification leadership in Indian held Jammu Kashmir is being denied its basic right of movement, assembly and of free speech. In a country that boasts of being the largest democracy in the world, this denial is a travesty of these fundamental rights when peaceful assembly and movement of legitimate leaders is not allowed to take place.

Over the past one year alone for example, Chairman of Jammu Kashmir Liberation Front- JKLF- Mr Muhammad Yasin Malik, has been denied right to assembly and free speech dozens of times. He has been prevented from engagement with people on many occasions through arrests, police and judicial custody and all too often put under house arrests. Mr Malik is also denied the right to a passport. As a result he is unable to visit and see his wife and child who reside in Pakistan.

Secretary of State, on both sides of the LoC, political parties that seek independence of Jammu Kashmir, are denied the right to participate in the political process, as candidates are required to declare their allegiance to India and Pakistan respectively. This is not only an undemocratic condition imposed on the candidates but also a denial of fundamental right to choice. As a result millions of people in both Azad Jammu Kashmir -AJK- and in Indian held Jammu Kashmir are disenfranchised by this undemocratic condition.

We would also like to draw your attention to the issue of Gilgit Baltistan which, the previous Peoples Party Government declared as a de-facto province of Pakistan and the current government of Mr Nawaz Sharif attempted to constitutionally formalise it as such. The process was halted due to concerted opposition from the public and the Kashmiri leadership across both sides of the LoC.
The move on the part of Pakistan government also contravened the spirit of UN Security Council-UNSC- resolution 122 of 24 January 1957 which, the UK supported and which stated “that an attempt to change the status of Jammu Kashmir or any part of the state would not constitute a disposition of the state.”

This particular resolution was passed by the UNSC to repudiate the National Conference Government in Indian held Jammu Kashmir which wished to ‘ratify’- in contravention of a plethora of previous UN resolutions and recommendations, the conditional ‘accession’ of Jammu Kashmir to India in 1947 by Maharaja Hari Singh.

We would therefore expect that the UK extends its advice to government Pakistan, not to proceed with the intention of incorporating Gilgit Baltistan as part of Pakistan federation. Furthermore we expect that the UK would encourage Pakistan Government to reunite Gilgit Baltistan region with AJK, to constitute a single territorial constitutional entity of Jammu Kashmir territories that are being administered by Pakistan since 1947.

Secretary of State the UK has a friendly and historic relationship with India and Pakistan and as such we would expect the UK government to extend strong and effective friendly advice to both countries, that they seriously address the question of Jammu Kashmir’s future political status with a purposeful and meaningful approach and actively involve the Kashmiris with their participation in the process under the UN’s auspices.

Secretary of State as a permanent member of the UNSC, Britain has a legal as well as a moral obligation, to ensure that all peaceful political processes are harnessed so that 20 million forcibly divided people of Jammu Kashmir have the opportunity to exercise their basic democratic right over the future political status of Jammu Kashmir.

JKLF Letter To High Representative of the European Union for Foreign Affairs and Security Policy

JKLF Letter To High Representative of the European Union for Foreign Affairs and Security Policy

H.E Madame Frederica Mogherini
High Representative of the European Union for Foreign Affairs and Security Policy
European Commission, Rue de la Loi/ Wetstraat 200
1049 Brussels Belgium
28 March 2016

Dear Madame Mogherini,

Sub: Is Mr Modi’s India Ready to engage for a peaceful Solution over Kashmir?

We first wrote to you in November 2014 reminding you of EU’s vital role for a just and peaceful resolution of the Kashmir issue, as well as welcoming you on succeeding Madame Ashton as the High Representative of the EU.

Today we take this opportunity and write to you again as the European Union-EU- welcomes Indian Prime Minister, Mr

Narendra Modi on 30 March 2016 in what is claimed by some MEPs with ‘open arms’.
As we seek a just and peaceful solution of the Kashmir issue we therefore ask the EU through your esteemed person: Is Mr Modi’s India ready to engage for a peaceful and lasting solution of the Kashmir issue based on the fundamental, inherent and inalienable rights of 20 million people  on both sides of the Line of Control-LoC?

However Madame Mogherini, before we take the liberty to ask some further questions regarding Mr Modi’s visit, we must put on record our profound sadness in connection with the recent terrorist attacks in Brussels and the loss of precious lives. We unequivocally condemn these heinous outrages and extend our sincere and heartfelt condolences to families of the deceased and the injured. Our prayers are with them and with the people of Belgium and hope that Brussels will soon return to normality with its customary welcoming and friendly atmosphere.

With reference to Mr Modi’s visit to the EU on 30 March 2016 we strongly hope that despite economic considerations with India, the EU will not overlook human rights violations being committed on daily basis in Kashmir by Indian military and para military forces. Madame innocent people-especially youngsters- are shot dead by the occupation forces under the cover of anti-people draconian laws.

The 700,000 Indian forces of occupation are responsible for the killing of 100,000 Kashmiris during the past 28 years.  There are 8000 missing people vanished without a trace. If Mr Modi is not responsible for these one wonders who is?  There are over 7000 unmarked graves throughout the Indian occupied part of Jammu Kashmir. Some of the most heinous acts of depravity have been committed against Kashmiri women by the Indian regular army. The occupation forces act with impunity under the cover of draconian laws such as Armed Forces Special Powers Act-AFSPA.

The populace of Indian occupied Jammu Kashmir is not only subjected to the militarised oppression but is also experiencing the communal fury that has been unleashed by the BJP and its extreme right wing allies in Indian occupied Jammu Kashmir with dire consequences.

Madame Mogherini it is not for us to remind you of what has happened under Mr Modi’s watch in India itself, as we always confine ourselves to the conduct of Indian occupation of Jammu Kashmir; but massacre of as many as two thousand innocent Indian citizens in Gujarat did take place when Mr Modi was Chief Minister there. Since Mr Modi and his Bharatiya Janata Party-BJP- came into power, India has become more intolerant and chauvinistic due to BJP’s nexus with the ultra-extremist Rashtriya Swayamsevak Sang-RSS, Shiv Sena and Vishwa Hindu Prashad-VHP.  The Indian Prime Minister therefore does not come to the EU with clean hands.

We look to you therefore, to take the Indian Prime Minister to task on the substantial issue of Kashmir’s future status, in accordance with India’s commitments on the matter at the United Nations. We hope and anticipate that you will remind Mr Modi of India’s responsibility to facilitate a plebiscite to ascertain the status of the territory in accordance with the unfettered democratic decision and expression of 20 million Kashmiris.

We would like to remind you Madame that the Kashmir issue is wrongly seen as a territorial dispute between India and Pakistan. And that India and Pakistan should not be considered the arbiters of Kashmir’s future status. This right Madame Mogherini is vested in the democratic expression of 20 million people of Jammu Kashmir, who along with their country are forcibly divided between India and Pakistan.

Madame Mogherini, the Indian Prime Minister must be reminded that on 1 January 1948 it was an Indian government which took the Kashmir issue to the United Nations. And the following is an example of  an earliest Indian commitment on Kashmir: “ that the question of Kashmir’s future status vis-a vis its neighbours and the world at large and the question on whether Kashmir should withdraw from her accession to India, and either accede to Pakistan or remain independent with a right to claim admission as a member of the UN all this we have recognised to be a matter for unfettered decision by the people of Kashmir after normal life is restored to them”  UNSC document Agenda 227.

Over the years successive Indian governments have hidden behind bilateral 1972 agreement- known as the Shimla Accord- between India and Pakistan to resolve the question of Kashmir’s future status. Thus far the entrenched positions of both countries and in particular, India’s intransigence, have yielded nothing by way of progress over the past 44 years. Since the bilateral agreement between India and Pakistan excludes the Kashmiris in the process, we Kashmiris do not recognise the Shimla Agreement.

India unfortunately has reneged on all its commitments in respect of Kashmir, it is our sincere hope that you will take to task the Prime Minister of ‘largest democracy’ for reneging on his country’s international commitments, solemn pledges and obligations on the inherent and inalienable rights and aspirations of Kashmiris, to determine the political destiny of their choice. This is nothing short of the   betrayal of the United Nations’ trust and that of the international community which was reposed in India over the status of Kashmir.

Mr Modi’s government denies pro freedom leadership the right of speech and assembly. The stifling of political and democratic expression is carried out through a combination of militarised oppression, police action, violent extremism and communal and chauvinist acts of the BJP and the RSS. For example over the past year alone, Chairman of the JKLF Mr Muhammed Yasin Malik  has been denied his basic democratic right of assembly and free speech  hundreds of times. This is hardly a reflection of a democratic society let alone the ‘largest democracy’!

Economic considerations, India’s very large population and its power of consumption apart- the EU with its fundamental principles of democracy, justice, equality and fairness, must not forsake the 20 million people of Jammu Kashmir. The EU more than others as a democratic economic and political block, must uphold the wishes, aspirations and rights of Kashmiri people.

Doing so is consistent with the basic principles and values of the EU. No one else will uphold the right of Kashmiris to justice and fairness. India and to a lesser extend Pakistan have both utterly failed to do so since 1947.

Madame Mogherini we urge you to make a start by taking the leader of the ‘largest democracy’- a democracy that incidentally has never extended beyond Indian border and into Indian occupied Jammu Kashmir- to task by asking him to meet India’s commitment over the future status of Kashmir.

We firmly believe that it would be an injustice to Kashmiris if the EU receives an Indian Prime Minister unconditionally with open arms as some Members of European Parliament –MEPs have suggested according to press reports.

JKLF organizes rally against incarceration of SAR Geelani, intimidation of Kashmiri students, use of pellet guns and pepper gas etc against Kashmiris...Several JKLF leaders including Showkat Ahmad Bakhshi arrested

Srinagar// Pellet-guns and pepper gas are tools of oppression, intimidation of Kashmir students in India states and prolonging imprisonment of veteran social leader Professor SAR Geelani is not acceptable . This was stated by the vice chairman JKLF Showkat Ahmad Bakhshi today while leading a protest rally at Koker Bazaar Lal Chowk Sgr.

JKLF leaders, activists and others in large numbers gathered at Koker Bazaar and started marching towards Lal Chowk. Raising slogans against intimidation of Kashmir students in Indian states, prolonged detention of SAR Geelani and illegal use of pellet guns and paper gas against peaceful Kashmiris, participates of the rally holding play cards and photographs of victims in their hands marched towards Lal chowk .

The rally were stopped by police at Koker Bazaar Chowk and after dispersing peaceful protestors by force, police arrested JKLF leaders and activists including Vice Chairman Shaukat Ahmad Bakhshi, Zonal General Secretary Sheikh Abdul Rashid, zonal organizing Bashir Ahmad Kashmiri, leader Professor Javed, members Imtiyaz Ahmad Ganaie, Basharat Ahmed, Ali Mohammad, Shakir Ahmad, Fayaz Ahmad Lone, Mohammad Hanif Dar, Irfan Ahmad Khan and Mohammad Afzal Shaikh .

Prior to his arrest, JKLF vice chairman Showkat Ahmad Bakshi while speaking to people present at the rally said that today’s protest is against use of deadly weapons like pellet guns and paper gas, that is being used to suppress peaceful protests and protesters in Kashmir and because of which hundreds of innocent young boys have lost their eye sight and vital organs etc.

Bakshi Sahib said that we are also protesting against intimidation of Kashmir students who are being terrorized in many Indian states and whose careers are on stake because of this intimidation.

He said that this is not acceptable and if this is not stopped immediately people of Kashmir will have no option but to launch a full-fledged agitation against this. While condemning the prolonged incarceration of veteran social leaders are educationist Prof SAR Geelani and other JNU students, Showkat Ahmad Bakshi said that this has exposed the double faced approach of Indian state.

He said that these arrests are actually a ploy to put a blanket ban on freedom of expression and India under the grab of democracy is actually promoting worst kind of dictatorial attitude through these measures.

Bakhshi sahib appealed international community to take notice of all these oppressive measures and save the lives and careers of Kashmiris.

Meanwhile JKLF leader Zahoor ahmad Butt today addressed people at Trehgam Kupwara. Protest against incarceration of Professor SAR Geelani others

Protest against incarceration of Professor SAR Geelani others

Protest against incarceration of Professor SAR Geelani others, held at Jenab sahib Soura….
India and its stooges have choked every little space for peaceful political activities, Political dissent and this is pushing youth to the wall //JKLF
Tributes paid to recently martyred youth…….

Jenab sahib Soura // Choking peaceful space on dissent and arresting people for sedition merely for standing with truth is a ploy to create an atmosphere of fear and intimidation. Prolonging incarceration of Professor SAR Geelani and others shows the double faced and hypocritical approach of Indian rulers. This was stated by the vice chairman JKLF Showkat Ahmad Bakhshi and others while speaking to people at Jenab Sahib Soura today. Earlier JKLF leaders and activists along with people from other walks of life participated in a protest rally held at Soura.

The rally was organized to stage protest against prolonging incarceration of noted educationist and social leader Professor SAR Geelani and others who are in jail under fake and manipulated sedition charges. Participants of the rally chanted slogans in favor of Azadi, Martyrs and immediate release of Professor Geelani and other students.

JKLF leaders Showkat Ahmad Bakhshi, Noor Muhammad Kalwal, Zahoor Ahmad Butt, Sheikh Khalid, Bashir Ahmad Kashmiri, Muhammad Sideeq shah, professor Javed, Showkat Ahmad Dar, Muhammad Maqbool Taploo , Ghulam Muhammad Dar, Muhammad Hanief and others were present on the occasion. While speaking to the participants of the rally, JKLF leaders said that India and its stooges have choked every little space for peaceful political activities. Political dissent and raising voice against oppression, tyranny and torture have been banned.

In Kashmir during 2008 and 2010 when people of Kashmiris transformed their struggle from violent to non violent, hundreds of young Kashmiris fell to the bullets of trigger happy Indians, thousands of young boys and youth were arrested and tortured and from then they along with their families are being humiliated on daily basis.

Speakers said that this oppression is pushing young Kashmiris to the wall and hence promoting worst kind of violence. Speakers said that this Indian oppression is responsible for the killings of our young buds and today because of this undemocratic and oppressive behavior we are receiving the corpses of our brilliant minds. While paying tributes to recently martyred Kashmiri youth Shaheed Ishaaq Ahmad Parray, Shaheed Asif Ahmad Mir and Shaheed Ashiq Hussain of Tral area, speakers said that these young boys are laying their lives for a just cause and we salute their sacrifices.

Speakers said that Indian rulers in their pursuit to suppress voices rising in support of Kashmir in Indian states have started intimidating people and charging them with black laws.

Today professor SAR Geealni and many students of JNU are in jails under concocted allegations and rulers and their authorities are trying everything possible to prolong their detention. Speakers said that SAR Geelani is a known social, human rights activist and has been raising his voice for political prisoners, human rights of Kashmiris and other human issues.

Speakers said that arresting SAR Geelani like people on concocted charges and putting them behind bar is condemnable and irony is that no one is today raising voice against Professor Geealni’s incarceration. Speakers said that Kashmiris will keep protesting against this ban on freedom of speech and thought, against incarceration of Professor Geelani and intimidating Kashmiris especially students studying in India.

On the occasion people chanted slogans against arresting Professor SAR Geelani and others and threatening Kashmiris living in India.
